Will using OEM approved memory from Sole Source Technology void your SmartNet Warranty™?


NO, the SmartNet warranty will not be voided.
 
Cisco Approved - Product that Cisco has tested and spec'd in as their own.
Cisco guarantees this product to meet and/or exceed all of the requirements listed under their SmartNet Warranty™. These products are part-number specific and purchased directly from the same OEM which manufactures Cisco's  Original product. The only difference is the label on the actual product. Approved products have the OEM (Finisar or Agilent) label on them.

The OEM specific part number printed on the label by the manufacturer will match the OEM part number found on Cisco AVL (Approved Vendor List).

Therefore, the only difference between Cisco Approved Products and Cisco Original Products is one bears the Cisco Label and one doesn't. Cisco will honor their Smartnet Warranty™ as long as the product has the correct OEM label and the OEM P/N on that label can also be found on Cisco's AVL.

> Third Party Components Support (Sole Source Technology’s Cisco Memory and GBIC’s are not Third Party, but are Approved Cisco Products)

> The Cisco guideline for support and warranty services for the use of third-party memory, cables, gigabit interface controllers (GBICs), filters, or other non-Cisco components is as follows:

> *   When a customer reports a product fault or defect and Cisco believes
> the fault or defect can be traced to the use of third-party memory
> products, cables, GBICs, filters, or other non-Cisco components by a
> customer or reseller, then, at Cisco's discretion, Cisco may withhold
> support under warranty or a Cisco support program such as SmartNet service.

> *   When a product fault or defect occurs in the network, and Cisco
> concludes that the fault or defect is not attributable to the use of
> third-party memory, cables, GBICs, filters, or other non-Cisco
> components installed by a customer or reseller, Cisco will continue to
> provide support for the affected product under warranty or covered by
> a Cisco support program.

> The nature of the defect or error is the key to determining Cisco
> support obligations.

> Cisco also reserves the right to charge the customer per then current
> time and material rates for services provided to the customer when
> Cisco determines, after having provided such services, that the root
> cause of the defective product was caused by a third party vendor supplied product.

Magnuson-Moss Warranty Act of 1975 / Sherman Antitrust Act

Federal Law protects consumers under the Magnuson-Moss Warranty Act of 1975 and the Sherman Antitrust Act. These laws prohibit manufacturers from the 'tie-in sales' provisions that attempt to intimidate customers into purchasing products (memory, GBICs for example) from the manufacturer, typically at much higher prices. Manufacturers cannot require that consumers purchase only their upgrades in order to maintain the product warranty. Additionally, by the law the manufacturer cannot state that their warranty will be voided if consumers purchase other brands of upgrades or peripherals. These laws were designed to encourage competition by allowing consumers to buy products they might have preferred to purchase elsewhere and on different terms.
